Real Scottish Journeys (RSJ) - Bike Hire Terms and Conditions
This hire contract is governed by Scottish Law and Custom.
You agree to hire the bicycle and accessories specified on your booking reservation (together, “equipment”), to pay the cost of hire, and you accept the terms on this contract.
The minimum legal age to ride an e-bike in Scotland is 14 years old.
Under 18’s must be accompanied by an adult at all times.
The bikes/e-bikes are hired for ROAD use only.
Photo ID
The lead hirer must provide photo ID at the time of commencement of the hire of the equipment. Further the hirer agrees to copies being made and held until equipment is returned in satisfactory condition.
You and your groups responsibility for equipment
You accept complete responsibility during the period of hire for the safe custody of the equipment and for any loss, theft or damage (howsoever caused). You are responsible for the security of the bicycle and must lock it to a fixed object whenever unattended and keep the equipment safeguarded at all times. You must return the equipment by the specified time and date. Any loss, theft, damage or accident should be notified to the hire company immediately and in the case of theft or accident to the nearest police station too. Please retain a copy of your booking invoice for confirmation.
Security Deposit and Late return surcharge.
A deposit of £100 per bike or e-bike shall be paid before hire commences and shall be refunded upon return of the equipment within 48 hours subject to the following terms. The deposit is to be held against any loss, theft, damage or failure to return the equipment by the specified time and date. If not returned by the specified time and date, an additional hire charge of £30.00 per hour will be charged. Any late return, replacement or repair costs or insurance excess payments may be deducted from the deposit. You shall pay any such costs in excess of the deposit.
Additional Damage and Theft liability.
I authorise RSJ to charge my credit/debit card for all costs in case of damage or loss to our equipment during my rental period. I will be responsible for reimbursing RSJ for the original cost of the bike/e-bike. of the rental.
Cycling has Risks
You accept that cycling has risks and confirm that you are a competent cyclist. You should not ride if you are in ill health, have a disability likely to affect ability to cycle, or your eyesight is not up to the standard required by a road driving test. Do not ride under the influence of alcohol, strong medication or other drugs. It is strongly advised that you wear a helmet and use other appropriate safety equipment and clothing.
Highway Code
Front and rear lights are required in hours of reduced light.
Please follow the highway code. Do not ride on pavements, against traffic, or more than two abreast. Do not run red lights. Be courteous to pedestrians and other road users. Ride responsibly: do not attempt any manoeuvres beyond your skill level or the bike’s specific capabilities.
Your responsibility
You accept full responsibility if you ignore any of the above and we are not liable for death or injury to any person or loss or damage to any property that results. Save in respect of liability for personal injury or death resulting from our negligence, the hire company’s liability to you whether in contract, tort (including negligence), breach of statutory duty or otherwise is limited to the cost of hire. You agree to indemnify us against any liabilities, costs, expenses, damages and losses arising out of or in connection with the death or injury to any person or any damage to property resulting from your hire or use of the equipment.
Recovery
RSJ is not responsible for recovery of the rider or bike/eBike in the event of fatigue, accident, punctures or discharged battery.
Other responsibilities of the hirer
All of our bikes/ e-bikes are maintained in roadworthy condition. But it’s the hirers responsibility of the to check the bike/e-bike before commencing with the hire. The hirer must look after the equipment and return everything in same condition. RSJ will charge for any damage. The bike/e-bike must be secured if left unattended. We advise that you do not ride without personal and third - party liability insurance.
Cancellation of Hire by RSJ
RSJ reserve the right to cancel a hire, right up to commencement of hire, if we feel that the hirers ability/size/experience is not a good match for equipment booked. In this instance we will offer a full refund. We also reserve the right to cancel the hire if equipment becomes unavailable because of circumstances out with our control. In such cases we will offer the customer a full refund.
Cancellation of Hire by Customer
If customer cancels up to 48 hours before the commencement of hire the is a 100% refund. If a customer fails to collect equipment at the agreed date, time and place there is no refund.
